The HRTO may schedule a Case Management Conference Call (CMCC) prior to the commencement of a hearing. Where the HRTO decides to hold a CMCC, notice will be issued to the parties by the Registrar. The notice will include information and directions about the date and time of the CMCC, the issues that may be dealt with at the CMCC, and any documents or other information which need to be shared with the parties ahead of the CMCC.
At the CMCC, the assigned adjudicator may:
The adjudicator at the CMCC may make oral and/or written rulings without detailed reasons on any preliminary or procedural issues that have been raised by the parties.
If a preliminary or procedural issue could have been raised by a party at or before the CMCC but was not, the adjudicator may not allow the party to raise the issue at a later time or at the hearing.
With the parties' consent, the adjudicator may engage in mediation/adjudication discussions with the parties at the CMCC or thereafter.
If a party who received notice of the CMCC does not attend, the CMCC may proceed in their absence, and any rulings made during the CMCC will be binding on all parties even if they were not in attendance.
If the applicant does not attend the CMCC, the Application may be dismissed as abandoned.
